1. Acceptance of Terms

By accessing or using Studio 1003, the website located at 1003.io, or any services provided by Mektra LLC ("Mektra," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our platform or services.

These Terms constitute a legally binding agreement between you and Mektra LLC. Please read them carefully before using our platform or services.

2. Eligibility

You must be at least 18 years of age to use Studio 1003. By accessing or using our platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are accessing Studio 1003 on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Studio 1003 is designed for licensed mortgage professionals. By requesting access, you represent that you are a licensed Mortgage Loan Originator (MLO) or are employed by a licensed mortgage company.

3. Description of Service

Studio 1003 is a mortgage CRM and pipeline management platform operated by Mektra LLC. We provide tools for lead management, power dialing, document management, compliance tracking, borrower communication, and team analytics. The service is provided on a subscription basis following an approval-gated registration process.

4. Account Registration and Access

Access to Studio 1003 requires submission of an access request, which is subject to review and approval by Mektra LLC. We reserve the right to approve or deny any access request at our sole discretion. You must provide accurate and complete information when requesting access and creating an account, including your NMLS ID where applicable. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Subscription and Billing

Studio 1003 offers subscription plans billed monthly. Approved accounts include a 7-day free trial with full platform access. Your payment method will be charged automatically at the end of your trial period unless you cancel before the trial ends. You can cancel your subscription at any time through your account settings or by contacting us. There are no long-term contracts, setup fees, or hidden charges.

6. Your Data

You retain ownership of all data you enter into Studio 1003, including borrower data, pipeline records, and uploaded documents. We do not claim ownership of your content. We process your data solely to provide the platform services as described in our Privacy Policy. We do not access, use, or share your data for any purpose other than delivering the Studio 1003 service.

7. Acceptable Use

You agree to use Studio 1003 in compliance with all applicable laws and regulations, including but not limited to mortgage lending regulations (RESPA, TILA, ECOA), data protection laws, telecommunications rules (TCPA, TSR), and state licensing requirements. You may not use the platform for any unlawful purpose or in any manner that could damage, disable, or impair our services.

8. Intellectual Property

All content on Studio 1003 and the 1003.io website, including but not limited to text, graphics, logos, images, software, and code, is the property of Mektra LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. The Studio 1003 name, logo, and all related marks are trademarks of Mektra LLC.

You may not, without our prior written consent:

  • Copy, reproduce, distribute, or create derivative works based on our content.
  • Modify, reverse engineer, decompile, or disassemble any portion of our platform or services.
  • Use our content for any commercial purpose without authorization.
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
  • Use any automated tools, bots, or scripts to access, scrape, or index our platform.

9. Service Availability

We strive to maintain high availability of the Studio 1003 platform. However, we do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned maintenance.

10. Disclaimer of Warranties

OUR PLATFORM AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MEKTRA LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that our platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or timeliness of any content or information on our platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEKTRA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF REVENUE, LOSS OF BUSINESS OPPORTUNITIES, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COST OF SUBSTITUTE SERVICES, OR DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA OR TRANSMISSIONS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) OUR PLATFORM, SERVICES, INTEGRATIONS, OR ANY THIRD-PARTY SYSTEMS ACCESSED THROUGH OUR PLATFORM, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR PLATFORM OR SERVICES EXCEED THE GREATER OF (A) THE TOTAL FEES ACTUALLY PAID BY YOU TO MEKTRA LLC DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIVE HUNDRED DOLLARS ($500). THIS LIMITATION APPLIES REGARDLESS OF WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF OUR PLATFORM, FROM INABILITY TO USE THE PLATFORM, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF THE PLATFORM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Mektra LLC, its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your use of our platform or services; (b) your violation of these Terms or any applicable law or regulation; (c) your violation of any rights of a third party; (d) your use of any integration, third-party service, or data obtained through the platform; (e) any content or data you submit, transmit, or store through the platform; (f) your communications or outreach activities conducted using or facilitated by the platform, including any claims related to TCPA, CAN-SPAM, or similar regulations; or (g) any claims arising from your failure to obtain required consents, licenses, or authorizations.

13. Termination

Either party may terminate the subscription at any time. Upon cancellation, you retain access to the platform through the end of your current billing period. We may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

14. Force Majeure

Mektra LLC shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, power outages, internet disruptions, pandemics, labor disputes, or acts of terrorism.

15. Integrations and Third-Party Services

Studio 1003 may integrate with or provide connectivity to third-party services and systems across a variety of categories, including but not limited to: loan origination systems (LOS), credit reporting agencies, product and pricing engines (PPE), telephony and VoIP providers, SMS and messaging platforms, email delivery services, document preparation and e-signature vendors, income and employment verification services, and other ancillary tools used in the mortgage origination workflow.

You acknowledge and agree that:

  • Third-party integrations are provided on an "as available" basis. Mektra LLC does not guarantee the availability, accuracy, reliability, completeness, or timeliness of any data, pricing, or functionality provided by or through third-party systems.
  • Third-party providers may change, suspend, deprecate, or discontinue their services, APIs, pricing, or data feeds at any time without notice to Mektra LLC. We are not responsible for any disruptions, errors, or losses resulting from such changes.
  • You are solely responsible for establishing and maintaining your own accounts with third-party providers, paying all fees owed to those providers, and complying with their respective terms of service, acceptable use policies, and applicable laws.
  • Mektra LLC makes no warranty regarding the accuracy, completeness, or suitability of data returned by third-party providers, including but not limited to credit data, pricing outputs, verification results, or document packages. We do not guarantee that any data submitted through the platform will be accepted by a downstream LOS or other system.
  • Certain features, integrations, or functionality may be designated as "beta," "alpha," "preview," or "experimental." Such features are provided without any warranty or commitment to continued availability, and may be modified, suspended, or removed at any time. Use of beta or experimental features is at your own risk.

16. Communications and Outreach

Studio 1003 may provide features that facilitate outbound communications, including but not limited to phone calls, SMS/text messaging, email campaigns, and other forms of electronic outreach to borrowers, leads, and other contacts.

You acknowledge and agree that:

  • You are solely responsible for ensuring that all communications conducted using or facilitated by the platform comply with all applicable federal, state, and local laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the Telemarketing Sales Rule (TSR), and any applicable state telemarketing or privacy laws.
  • You are responsible for obtaining and documenting all required prior express consent (including prior express written consent where required) from recipients before initiating calls, text messages, or other communications through the platform.
  • You must honor all opt-out, do-not-call, and unsubscribe requests promptly and in accordance with applicable law. You are responsible for maintaining internal do-not-contact lists as required.
  • You must comply with all carrier policies, messaging guidelines, and registration requirements (such as 10DLC or A2P messaging registration) applicable to your communications.
  • Mektra LLC does not guarantee the deliverability of any call, text message, email, or other communication. Delivery is subject to carrier networks, spam filters, recipient device settings, provider routing, and other factors outside our control.
  • Mektra LLC does not guarantee connectivity, call quality, or uptime of telephony or messaging services, which depend on third-party providers and telecommunications infrastructure.

17. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our platform or services shall be resolved through binding arbitration administered in the State of Arizona in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator, and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Mektra LLC.

30-Day Opt-Out Window: You may opt out of this arbitration provision by sending written notice to Mektra LLC at 60 E Rio Salado Pkwy Ste 900, Tempe, AZ 85281 within thirty (30) days of your first use of our platform or services. Your written notice must include your full name, mailing address, and a clear statement that you wish to opt out of the arbitration provision in these Terms of Service.

18. Export Compliance

You agree to comply with all applicable United States export control laws and regulations. You may not use, export, or re-export any content or services from our platform in violation of such laws, including to any country, entity, or individual subject to United States sanctions.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of laws principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

21. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. Your continued use of our platform or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
