Acceptable Use Policy

1. Overview
This Acceptable Use Policy ("AUP") governs your use of the Studio 1003 platform and all related services operated by Mektra LLC ("Mektra," "we," "us," or "our"). This AUP is incorporated by reference into our Terms of Service. By using Studio 1003, you agree to comply with this AUP in addition to the Terms of Service.
We may update this AUP from time to time. Your continued use of the platform after any changes constitutes acceptance of the revised policy.
2. Prohibited Activities
You may not use Studio 1003 or any of its features, integrations, or services to engage in any of the following activities:
- Spam and Unsolicited Communications: Sending unsolicited bulk emails, text messages, or phone calls, including messages to individuals who have not provided prior express consent or who have opted out of communications.
- Illegal Robocalling: Initiating automated or prerecorded telephone calls or text messages in violation of the Telephone Consumer Protection Act (TCPA), Telemarketing Sales Rule (TSR), or any applicable federal, state, or local telecommunications law.
- Harassment and Abuse: Using the platform to harass, threaten, intimidate, or abuse any individual, including borrowers, co-workers, or third parties.
- Fraudulent Activity: Using the platform to engage in fraud, misrepresentation, identity theft, or any deceptive practice, including falsifying borrower information, loan data, or compliance records.
- Scraping and Data Extraction: Using automated tools, bots, scripts, crawlers, or other automated means to access, scrape, index, or extract data from the platform.
- Reverse Engineering: Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithms, or underlying structure of the platform or any of its components.
- Abusive Load and Resource Consumption: Placing unreasonable or disproportionate load on our infrastructure, including denial-of-service attacks, excessive API calls, or any activity designed to degrade platform performance for other users.
- Unauthorized Access: Attempting to gain unauthorized access to any part of the platform, other user accounts, or systems connected to the platform, including probing, scanning, or testing the vulnerability of the platform without authorization.
- Malware and Harmful Code: Uploading, transmitting, or distributing viruses, malware, ransomware, spyware, or any other harmful or malicious code through the platform.
- Illegal Use: Using the platform for any purpose that violates applicable federal, state, or local law, including mortgage lending regulations, fair lending laws, anti-discrimination statutes, and anti-money laundering requirements.
- Provider Rule Violations: Using the platform in a manner that violates the terms, policies, or acceptable use requirements of any third-party service provider integrated with or connected to Studio 1003, including telephony carriers, messaging providers, credit bureaus, and loan origination systems.
- Resale or Redistribution: Reselling, sublicensing, or redistributing access to the platform or any of its features without our prior written consent.
3. Telephony and Messaging Obligations
If you use any telephony, dialing, SMS, or messaging features available through Studio 1003, you are solely responsible for:
- Obtaining all required prior express consent (including prior express written consent where required) from recipients before initiating calls or sending messages.
- Maintaining accurate and up-to-date records of consent for each recipient.
- Honoring all opt-out requests promptly and maintaining an internal do-not-contact list.
- Complying with all applicable federal, state, and local laws governing telephone calls and electronic messages, including the TCPA, TSR, CAN-SPAM Act, and any applicable state mini-TCPA statutes.
- Complying with all carrier policies, industry guidelines, and best practices for voice and messaging, including caller ID requirements and A2P messaging registration.
- Ensuring that all communications are truthful, not misleading, and compliant with applicable advertising and marketing regulations.
Studio 1003 provides tools to support your communication workflows, but compliance with telecommunications and messaging laws is your responsibility. We do not monitor the content or recipients of your communications and are not liable for your failure to comply with applicable laws.
4. Email and Electronic Communications
If you use any email features available through Studio 1003, you agree to:
- Comply with the CAN-SPAM Act, including providing a valid physical postal address and a clear opt-out mechanism in every commercial email.
- Honor opt-out and unsubscribe requests within the timeframe required by law.
- Refrain from using deceptive subject lines or misleading header information.
- Refrain from sending email to purchased or rented lists without proper consent.
5. Content Standards
You are responsible for all content you create, upload, transmit, or store through Studio 1003. You agree that your content will not:
- Contain any material that is defamatory, obscene, threatening, or otherwise objectionable.
- Infringe on the intellectual property rights of any third party.
- Contain false, misleading, or deceptive information.
- Violate any applicable law or regulation.
6. Consequences of Violation
If we determine, in our sole discretion, that you have violated this AUP, we may take one or more of the following actions:
- Issue a warning and request that you cease the violating activity immediately.
- Temporarily suspend your access to the platform or specific features.
- Permanently terminate your account and access to the platform.
- Remove or disable access to any content that violates this AUP.
- Report the violation to appropriate law enforcement authorities or regulatory agencies.
We are not obligated to provide advance notice before taking action, although we will make reasonable efforts to notify you when appropriate. Suspension or termination for an AUP violation does not entitle you to a refund of any fees paid.
7. Reporting Violations
If you become aware of any violation of this AUP, please report it to us at [email protected]. We will investigate reported violations and take appropriate action.
8. Relationship to Terms of Service
This AUP supplements and is incorporated into our Terms of Service. In the event of a conflict between this AUP and the Terms of Service, the Terms of Service shall control. All defined terms used in this AUP and not otherwise defined herein have the meanings given to them in the Terms of Service.
